Terms and Conditions

1. Introduction
These Terms and Conditions govern all sales, services, and transactions carried out through www.mdmaison.com and other MDMAISON communication channels. By placing an order, you acknowledge that you have read, understood, and agreed to these Terms.
The placement of an order by the Client constitutes an offer to purchase. A legally binding contract is formed only when MDMAISON issues written confirmation of the order and, unless otherwise agreed in writing, receives full payment. Until such confirmation is issued, MDMAISON shall not be obliged to supply the products or services.
MDMAISON reserves the right to update or modify these Terms from time to time. Any updated version shall be published on the website with a revised “Last updated” date and shall apply to orders placed after the date of publication, unless otherwise required by law. No amendment shall retroactively affect orders already confirmed by MDMAISON, unless required by mandatory law.
2. Scope of Services
MDMAISON specializes in premium tableware and décor, available both online and through personalized project services. A complimentary product curation service is included with each order.
Where a project requires extended sourcing, repeated revisions, custom research, or a broader design-curation scope beyond the complimentary service ordinarily included with an order, MDMAISON may offer a separate paid consultation, curation service, or project reservation service subject to prior written agreement. Any such fee, deposit, or reservation amount, including whether it is creditable toward a future purchase, must be agreed in advance in writing before it becomes payable.
In selected cases, MDMAISON may require a non-refundable project deposit or curation fee before commencing extended sourcing or bespoke selection work.
MDMAISON reserves the right, prior to contract formation, to refuse service, decline an order request, suspend communications, or restrict access to services in cases including abusive or inappropriate conduct, suspected fraud, misuse of services, repeated unreasonable revision requests without genuine purchasing intent, or material breach of these Terms. Where a contract has already been concluded, MDMAISON may exercise any rights of suspension, cancellation, or termination only where permitted by these Terms or applicable law.
3. Orders and Availability
All products displayed on our website are subject to availability. The presence of an item online does not guarantee it is in stock. Once an order is placed, MDMAISON will confirm product availability, production times, and shipping costs. If an item is unavailable and the Client does not wish to wait, a full refund will be provided.
For the avoidance of doubt, products may be in stock, made to order, sourced on demand, specially ordered from third-party brands or manufacturers, or allocated specifically for a Client following order confirmation.
Where a product is made to order, customized, personalized, specially sourced, specially ordered, reserved, commissioned, finished, or allocated specifically for the Client in reliance on the Client’s confirmed order, such order may not be cancelled, changed, or returned for convenience once confirmed, except in the case of proven defect, damage in transit where MDMAISON bears the transport risk, or where mandatory law requires otherwise.
Clients are responsible for maintaining confidentiality of any payment links or login details. MDMAISON is not liable for unauthorized use resulting from client negligence.
MDMAISON reserves the right to correct typographical errors, inaccuracies, or omissions relating to pricing, product descriptions, specifications, availability, lead times, or shipping information at any time before contract formation. If such an error is identified before order confirmation, MDMAISON may reject the order request and refund any amount already paid. If a material error is discovered after order confirmation, MDMAISON will inform the Client and, where required by applicable law, offer an appropriate remedy.
By accessing this website, the Client agrees not to copy, reproduce, scrape, distribute, or commercially exploit any content without prior written consent; not to use automated systems, bots, or data extraction tools; and not to interfere with the website’s security, functionality, or infrastructure. MDMAISON reserves the right to suspend or restrict access in case of breach.
4. Payment Terms
Payments are securely processed via Stripe or by bank transfer for trade clients. Orders placed without immediate payment will receive a quotation including availability, production lead times, and shipping costs. Orders will only be processed upon receipt of full payment. Products remain the property of MDMAISON until full payment is received.
In the event of a payment dispute, reversal, or chargeback, MDMAISON reserves the right to suspend further performance, withhold shipment, request supporting information, contest the chargeback, and recover any amounts wrongfully reversed together with any direct third-party costs actually incurred, where permitted by applicable law.
5. Pricing, Taxes and Duties
Prices may be displayed in EUR, USD or other currencies for convenience. All transactions are processed in the currency chosen at checkout. Payments made in currencies other than EUR may be subject to exchange rate variations or bank fees, which are the responsibility of the buyer.
For orders shipped outside the EU, import duties, local taxes and customs charges are not included in the product price unless expressly stated otherwise and are the buyer’s responsibility. If the buyer refuses to pay such duties and the goods are returned, MDMAISON reserves the right to deduct any return shipping, storage, customs, brokerage, handling, or other import-related costs from any refund.
6. Promotions and Special Offers
Promotions, discounts or complimentary shipping are valid only during the period stated on the website and cannot be applied retroactively. MDMAISON reserves the right to modify or withdraw promotions at any time.
7. Delivery and Risk
Delivery is not included in the product price unless expressly stated as part of a promotion or complimentary offer. After placing an order, MDMAISON will provide delivery options, shipping costs and estimated delivery times for client approval.
Unless otherwise agreed in writing, international deliveries arranged by MDMAISON are made under DAP (Delivered At Place) Incoterms® 2020, as published by the International Chamber of Commerce. Unless otherwise stated, MDMAISON arranges export formalities where applicable, while import duties, local taxes, customs clearance, and destination formalities remain the responsibility of the Client.
MDMAISON may, at its sole discretion, offer delivery either under DAP (Delivered At Place) Incoterms® 2020 or, in selected cases, under DDP (Delivered Duty Paid) Incoterms® 2020.
Under DAP, the Client is responsible for import duties, import taxes, customs clearance, and any destination formalities.
Under DDP, where expressly offered and confirmed by MDMAISON in writing, MDMAISON arranges delivery inclusive of agreed import duties, import taxes, customs clearance, and destination formalities, subject to the scope expressly stated in the order confirmation.
Where DDP is offered, the Client may be given the option, subject to MDMAISON’s written approval, either:(a) to pay the applicable duties, taxes, and import-related charges directly to MDMAISON in advance as part of a simplified delivery arrangement; or(b) to pay such charges through the transport provider, customs broker, or other designated third party, where such option is expressly agreed in writing before shipment.
The delivery model selected and confirmed for the order, including whether delivery is made under DAP or DDP and whether import charges are paid to MDMAISON or directly to the transport provider, shall be final and may not be changed after order confirmation except at MDMAISON’s sole discretion and subject to any resulting additional costs, delays, administrative charges, customs consequences, or carrier fees, all of which shall be borne by the Client where applicable.
If the Client fails, refuses, or delays in providing information, documents, authorizations, tax identification details, or payments required for customs clearance, import processing, or final delivery, MDMAISON reserves the right to suspend shipment, withhold release of the goods, charge the Client for any resulting storage, demurrage, customs, transport, return, brokerage, handling, or administrative costs, and/or treat such failure as a refusal of delivery.
If delivery is arranged by MDMAISON under DAP or DDP, risk transfers to the Client upon physical receipt of the goods from the courier, unless mandatory law provides otherwise.
If the Client arranges their own courier or collects from a designated warehouse, showroom, partner address, or other agreed point of handover, risk transfers once the goods are handed to the Client’s carrier or representative.
Visible transport damage, packaging damage, shortage, tampering, or any externally apparent issue must be noted on the courier’s delivery documentation where available and reported to MDMAISON in writing within 2 business days of delivery, together with photographs. This deadline is intended to preserve transport, insurance, and carrier-related claims.
Where delivery is arranged under DAP and the Client fails to pay import duties, taxes, or customs charges when due, MDMAISON shall have no liability for any delay, non-delivery, return, seizure, storage charge, or additional cost arising from such failure, and any such cost incurred by MDMAISON may be deducted from any refund or charged to the Client on demand.
DDP may be offered only for selected destinations, order values, product categories, or clients, and only where MDMAISON considers such arrangement feasible. MDMAISON reserves the right to refuse DDP for any destination or transaction, including where local law, customs practice, tax registration requirements, broker restrictions, or carrier limitations make DDP impracticable or commercially unreasonable.
Any duties, taxes, brokerage fees, customs advances, disbursement fees, storage charges, inspection fees, or other import-related amounts quoted by MDMAISON before shipment are estimates unless expressly stated otherwise. If the actual charges exceed the estimate due to customs reclassification, valuation changes, carrier surcharges, governmental measures, or other causes beyond MDMAISON’s reasonable control, the Client shall remain responsible for the difference unless otherwise expressly agreed in writing.
Any customs clearance times, import release dates, and delivery estimates are indicative only and depend on third-party authorities, customs systems, and carriers. MDMAISON shall not be liable for delays caused by customs review, inspection, documentation requests, valuation adjustments, border controls, or regulatory action.
MDMAISON is not liable for delays caused by customs, logistics providers, weather, strikes, or circumstances beyond reasonable control.
Where delivery is arranged under DDP and the goods are subsequently returned, refused, cancelled after shipment, or not accepted by the Client for any reason other than a proven defect, proven transit damage where MDMAISON bears the transport risk, or another circumstance expressly required by mandatory law, any import duties, import VAT, customs clearance charges, brokerage fees, disbursement fees, handling charges, or similar import-related amounts paid, advanced, or incurred by MDMAISON in connection with the DDP shipment shall be non-refundable.
For the avoidance of doubt, such amounts are separate from the price of the goods and reflect taxes, duties, customs formalities, and third-party import services incurred for the purpose of delivering the order under the agreed DDP model.
If any such duties, taxes, or import-related charges are later refunded, credited, remitted, or otherwise recovered by MDMAISON from the relevant customs authority, carrier, broker, tax authority, or other third party, MDMAISON may, at its discretion and subject to deduction of any actual administrative, brokerage, banking, filing, legal, or service costs incurred in obtaining such recovery, pass on to the Client the amount actually recovered. Any such recovery depends on applicable law, customs procedures, filing deadlines, documentary requirements, and decisions of the relevant authorities and third parties, and is therefore not guaranteed by MDMAISON.
8. Returns and Claims
Products damaged during shipping or with visible manufacturing defects may be eligible for return, replacement, repair, refund, or another appropriate remedy, depending on the circumstances and applicable law. Damage must be documented with photographs and reported by email. Goods must not be disposed of until further instructions are provided by MDMAISON.
Any visible manufacturing defect apparent upon reasonable inspection after unpacking must be reported to MDMAISON in writing within 7 days of receipt, together with supporting photographs and a description of the issue.
The reporting periods in Sections 7 and 8 serve different purposes. The 2-business-day period applies to transport-related damage, shortage, tampering, or packaging issues. The 7-day period applies to visible manufacturing defects identified upon reasonable inspection after delivery.
The reporting periods above are intended to facilitate prompt review of transport and supplier claims and do not limit any mandatory statutory rights available to consumers under applicable law in relation to lack of conformity existing at the time of delivery.
For consumers in the European Union, statutory rights in relation to lack of conformity apply only to defects or non-conformity existing at the time risk passed to the consumer, subject to applicable law. These rights do not extend to normal wear and tear, accidental damage, breakage, chipping or scratching occurring after delivery, improper handling, storage, cleaning, installation or use, failure to follow care instructions, or characteristics inherent in artisanal, handmade, or natural materials and finishes, where such characteristics were disclosed or could reasonably be expected.
If you are a consumer residing in the European Union, you may have the right to withdraw from a distance contract within fourteen (14) days without giving any reason, except where an exception applies under applicable law or these Terms. The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, you must notify MDMAISON by a clear written statement sent to info@mdmaison.com before the withdrawal period expires.
Returned goods must be sent back without undue delay and, in any event, no later than 14 days after the day on which you communicated your withdrawal.
The Client is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Where a consumer has a statutory right of withdrawal, the direct cost of return shipping shall be borne by the Client only if this is clearly communicated by MDMAISON before the order is placed, including at checkout or in other pre-contract information provided to the Client.
MDMAISON will reimburse payments received for the withdrawn goods in accordance with applicable law and may withhold reimbursement until the goods are returned or evidence of return is provided.
The right of withdrawal does not apply to goods that are made to the Client’s specifications, personalized or customized for the Client, produced, sourced, finished, or specially ordered on demand for the Client, or supplied as special-order items not ordinarily kept in stock by MDMAISON.
For the avoidance of doubt, a product shall be treated as made-to-order or special-order where MDMAISON purchases, commissions, reserves, manufactures, finishes, or allocates the item specifically in reliance on the Client’s confirmed order, including orders placed with partner brands, ateliers, or manufacturers.
Where a return concerns an order delivered under DDP, any refund for the goods shall exclude non-refundable import duties, import VAT, customs clearance charges, brokerage fees, and other import-related amounts incurred in connection with the delivery, except to the extent such amounts are actually recovered by MDMAISON from the relevant authority or service provider.
Goods must not be disposed of, altered, repaired, or restored by third parties without MDMAISON’s prior written approval, unless required for immediate safety reasons.
9. Trade Program
MDMAISON offers a Trade Program for interior designers, architects and hospitality professionals. To access trade benefits, clients must register, provide company details and project information. MDMAISON reserves the right to approve, refuse or revoke Trade access at its discretion. Trade discounts, payment terms and lead times are provided upon approval and are not publicly disclosed.
Trade purchases are business-to-business transactions unless expressly agreed otherwise in writing and may be subject to separate commercial terms, quotations, payment schedules, shipping arrangements, return restrictions, or project-specific conditions.
10. Product Information and Craftsmanship
Many products are handcrafted; variations in color, texture or finish are inherent and not considered defects. Images are for illustrative purposes only. Some images are provided by partner brands or manufacturers with permission and remain their intellectual property.
Many MDMAISON products are handcrafted, hand-finished, or made using artisanal processes. Variations in glaze, tone, texture, shape, brushwork, patina, edge detail, or finish, as well as minor irregularities consistent with the manufacturing method, are inherent characteristics of such products and shall not be regarded as defects. The same applies to natural variations in materials such as wood, stone, linen, leather, porcelain, ceramic, or metal where such variation is customary and aesthetically inherent to the product.
Suitability for dishwasher, microwave, oven, or food-service use applies only where expressly stated in writing in the product information or care instructions. The Client is responsible for following all care, washing, handling, and use instructions provided by MDMAISON or the relevant manufacturer. MDMAISON shall not be liable for damage resulting from commercial or intensive use beyond the product’s intended purpose, improper washing or cleaning products, thermal shock, impact, stacking damage, negligent handling, unsuitable storage conditions, or use inconsistent with the product description or care guidance.
For the avoidance of doubt, the provisions of this Section relate to product characteristics, artisanal variation, and the distinction between inherent characteristics and defects. They do not, by themselves, exclude any statutory withdrawal rights that may apply under mandatory law to eligible consumer purchases.
11. Intellectual Property
All text, images, designs and materials on www.mdmaison.com are the property of MDMAISON or its partners. They may not be reproduced, published or distributed without written permission.
12. Force Majeure
MDMAISON is not liable for delays or non-performance due to events beyond its control, including natural disasters, war, terrorism, pandemics, strikes, transport failures or regulatory restrictions.
13. Limitation of Liability
MDMAISON’s liability shall not exceed the total amount of the order. We are not responsible for indirect or consequential damages, including loss of profit or data. MDMAISON is not responsible for the functionality, security or performance of third-party services, including payment gateways, hosting, logistics or analytics platforms.
To the maximum extent permitted by applicable law, MDMAISON shall not be liable for indirect, incidental, special, or consequential damages, including loss of profit, revenue, business opportunities, goodwill, or data. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by negligence, or any liability that cannot legally be excluded or limited under applicable law.
14. Governing Law and Jurisdiction
These Terms are governed by Estonian law and applicable mandatory EU consumer protection rules where relevant.
The parties shall first attempt to resolve any dispute, claim, or disagreement through good faith negotiations.
Any dispute shall be submitted to the courts of Tallinn, Estonia, except where mandatory consumer protection law grants the consumer the right to bring proceedings in another competent court.
Nothing in this clause limits any mandatory rights of consumers under applicable law.
Consumers may also contact their local consumer protection or consumer assistance bodies where such rights or assistance mechanisms are available under applicable law.

These Terms and Conditions apply to all sales and services provided by MDMAISON OÜ, registered in Estonia, through www.mdmaison.com. Nothing in these Terms shall be construed as creating a partnership, joint venture, or agency relationship between MDMAISON and the Client.
MDMAISON processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms. Personal data may be processed where necessary for the performance of a contract, compliance with legal obligations, the pursuit of legitimate business interests, or on the basis of consent where consent is required by applicable law. By using the website or placing an order, you acknowledge that your personal data will be processed as described in the Privacy Policy.
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
